The details regarding the prize(s) are included in each  contest description and procedures below for entering each respective contest are contained in the Official Rules below.

OFFICIAL RULES

In consideration of any participation in the contest described below, all of the following terms and conditions (the “OFFICIAL RULES”) are hereby agreed to by any such participant.

ELIGIBILITY. The contest herein, comprised of the One Hundred Contest (the “Contest”), by which various Belmont Park daily passes and Ralphs Grocery Company gift cards are eligible to be won, is only open to legal residents of the State of California where permissible by law, who are of legal age of majority in the jurisdiction in which they reside (and at least 18 years old at the time of entry). Employees, officers and directors (including the immediate family, spouse, child, sibling, parent and their respective spouses, regardless of where they reside, of any of them) and entrants of the same household, whether or not related) of Belmont Park Entertainment LLC (the “Sponsor”), Ralphs Grocery Company the promoter or partner (if applicable) and each of their respective parents, affiliated companies, subsidiaries, landlords, advertising and promotion agencies associated with the Contest are not eligible to participate or win a prize. Proof of residency and age may be required.  The Contest is subject to all applicable federal, state, and local laws, rules and regulations.  Void outside where otherwise prohibited or restricted by law, rule or regulation. Entrants of the Contest are eligible to win two (2) daily passes to Belmont Park and a one hundred dollar ($100.00) Ralphs Gift Card. For rules relating to daily passes to Belmont Park, see the “Park Pass Terms and Conditions” attached hereto. 

TIMING. The Contest timing begins March 1, 2025, and ends on May 31, 2025 (the “Promotion Period”). Entries received outside of the Promotion Period are disqualified.

TO ENTER. The Contest may be entered via the designated methods only during the Promotion Period.  No other methods of entry will be accepted. Limit one (1) entry per person, per e-mail address, per household and Facebook login per day, regardless of method of entry. Multiple entries received from any person or e-mail address or household in excess of the stated limitation will be void.

Online Method: Entrants can enter the Contest during the Promotion Period by accessing and completing the entry form located on belmontpark.com/ralphs. Follow the instructions on the screen and complete the online entry form. Entrants must complete all required information in order to be eligible. Any attempt by a person to enter more than once per day with multiple email accounts may result in disqualification at the discretion of Sponsor upon verification of prize winner. It is each entrant’s responsibility to ensure timely submission of entries. No submissions will be accepted after the deadline for any reason. The sole determinant of time for the purposes of online entries will be Sponsor’s server machine(s) located in the Pacific time zone.

USE OF DATA. Sponsor will be collecting personal data about participants (including, without limitation, name, phone number, mailing address, gender, age e-mail addresses) when they enter the Contest online. Entrants grant to the Sponsor, and the Sponsor and Ralphs reserve, the right to use any and all information related to the Contest, including information provided by entrants in connection with the Contest, for any purpose, unless prohibited by law. Entrants may be required to sign a release, which grants the Sponsor the right to use and publish their proper name online or in any other media in connection with the either Contest.  In order to accept a prize, entrants (excluding where otherwise prohibited by law), shall be required to sign a release that grants permission to the Sponsor to use his or her name, photograph, likeness, prize information and/or biographical information without future compensation. 

AGREEMENT TO OFFICIAL RULES. Participation in the Contest constitutes entrant's full and unconditional agreement to and full acceptance of these Official Rules and to be contacted by telephone and/or email. Odds of winning depend on the total number of eligible entries received during the Promotion Period.

SELECTION/NOTIFICATION OF POTENTIAL WINNER.  Potential winner(s) will be selected in a random drawing to be held each week and contacted in the sole discretion of the Sponsor by e-mail and/or telephone. Sponsor's decisions as to all matters related to the administration of the Contest and selection of any of the winners thereof are final. Each potential winner must comply with all terms and conditions set forth in these Official Rules, and winning an award or prize is contingent upon fulfilling all requirements. If a potential winner cannot be contacted within a time deemed reasonable by the Sponsor but not less than twelve (12) hours after the first attempt to contact such potential winner, an alternate entrant will be selected in his or her place at random from all eligible entries received.

PRIZE:  The prize shall be described via the Contest page including Approximate Retail Value (“ARV”).

Winner’s guest(s) must be of legal age of majority in their jurisdictions of residence unless accompanied by his/her parent or legal guardian.

The winner is fully responsible for any and all applicable federal, state, and local taxes (including income and withholding taxes). All costs and expenses associated with any prize acceptance and use not specified herein as being provided, including but not limited to lodging accommodations, any transportation costs, luggage fees, parking meals, gratuities and other expenses incurred by accepting the prize are the sole responsibility of winner. All prize details are at Sponsor’s sole discretion and may be changed at any time.

Except where otherwise expressly noted in these Official Rules, the selection of all vendors, prizes, products and services is subject to the Sponsor’s sole and absolute discretion. Prizes (and/or any portion thereof) are non-transferable and non-exchangeable. No refunds or credit for changes is allowed. No substitutions or cash redemption of any prize is permitted except that Sponsor retains the right to substitute a prize (or portion thereof) with one of comparable or greater retail value (or at Sponsor's election, the cash value of the applicable prize) at its sole and absolute discretion.  Additional restrictions may apply.

The terms and conditions of any tickets awarded as prizes will govern if an event is not held due to weather, an Act of God, an act of terrorism, civil disturbance, work stoppage or any other reason. Winner and his/her guest(s) agree to comply with all applicable venue regulations in connection with the Prize. Sponsor reserves the right to remove or deny entry to winner and/or his/her guest(s) who engage(s) in a non-sportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten or harass any other person at Sponsor’s property. Releasees (as defined above) will not be responsible for weather, Acts of God, acts of terrorism, civil disturbances, work stoppage or any other event that may cause the cancellation or postponement of any event.

WAIVER OF LIABILITY.  The winner must execute and return to Sponsor liability waiver upon Sponsor’s request of entrant’s entrance at any Belmont Park property at any time, and if requested by Sponsor, a W9, prior to receipt of Prize.

GENERAL CONDITIONS.  Except where prohibited by law, the winner grants to Sponsor and its advertising agencies the right to use and publish winner's photo, proper name, likeness, voice, opinions, biographical information and state in any media to promote the Contest without additional compensation.

By entering the Contest, each entrant forever waive any and all claims or cause of action against Sponsor, Ralphs Grocery Company, Facebook, Instagram, X, any companies or prize providers associated with the Contest and each of its and their respective parent companies, subsidiaries, affiliates, owners, members, shareholders, directors, officers, employees and agents (each a “Releasee” and collectively the, “Releasees”) arising out of participation in the Contest or receipt or use or misuse of any prize, including, but not limited to any injury or damage to persons or property, including death, which may be caused, directly or indirectly, in whole or in part, from entrant’s participation in the Contest or receipt of any prize, including without limitation, any cancellation or postponement of any prize event or any travel or activity related to the receipt or use of any prize. The foregoing release is subject and subordinate to the terms of the PARK PASS TERMS AND CONDITIONS, below.

Sponsor reserves the right to cancel or modify the Contest if fraud or any other factor impairs the integrity of the Contest as determined by Sponsor in its sole discretion.

WITHOUT LIMITING THE GENERALITY OF THE FOREGOING, ANY PRIZE HEREIN IS PROVIDED “AS IS” WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED AND THE RELEASEES (DEFINED ABOVE) HEREBY DISCLAIM ALL SUCH WARRANTIES, INCLUDING BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND/OR NON-INFRINGEMENT.

Online entries are deemed made by the authorized account holder of the e-mail address submitted at the time of entry. The "authorized account holder" is deemed the natural person who is assigned to an e-mail address by an Internet access provider, service provider or other online organization that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address. A potential winner may be requested to provide Sponsor with proof that the potential winner is the authorized account holder of the e-mail address associated with the winning entry. The prize will only be awarded to the authorized account holder. Prizes are not transferrable under any circumstances.

If, in Sponsor’s opinion, there is any suspected or actual evidence of electronic or non-electronic tampering with any portion of the Contest, or if technical difficulties compromise the integrity of the Contest, Sponsor reserves the right in its sole discretion to void any entries at issue (including disqualifying any individual who tampers or otherwise interferes with the entry process), and to cancel, terminate, modify or suspend the Contest, in whole or in part, at any time without notice. In the event of such cancellation, Sponsor reserves the right to award prize in a random drawing from all eligible entries received before the time of cancellation. Sponsor in no way promotes illegal acts, and any and all entries which include or promote illegal acts will be disqualified.

Sponsor assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction of unauthorized access to, or alternation of, entries. Sponsor is not responsible for any problems or technical malfunction of any telephone network or lines, computer online systems, servers, or providers, computer equipment, software, failure of any e-mail or entry received by Sponsor on account of technical problems or traffic congestion on the Internet or at any web site, any combination thereof, or otherwise, including any injury or damage to entrant's or any other person's computer related to or resulting from participation or downloading any materials in the Contest.

CAUTION: ANY ATTEMPT BY AN ENTRANT TO DELIBERATELY DAMAGE ANY WEB SITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, THE SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW.  

DAILY PARK PASS TERMS AND CONDITIONS 

By accepting a Belmont Park Daily Pass (the “Daily Pass”), contest entrant (“Entrant”) agrees to be bound by the Belmont Park Daily Pass Terms and Conditions (these “Terms and Conditions”) herein and any other rules and regulations applicable to the use of the Daily Pass as Belmont Park Entertainment LLC, a Delaware limited liability company, or any of its successors, affiliates, or agents (the “Park”),  may set or change, at its sole discretion, including all those printed on the front and/or backside on the Daily Pass card.  

The Daily Pass is valid indefinitely subject to the applicable restrictions as set forth herein, and is only valid at participating Belmont Park sites, which shall be determined by the Park in its sole and absolute discretion. The Daily Pass is not valid for private events or events that require a separate admission. Capacity, height and weight restrictions apply to entry of each ride and attraction. The Daily Pass restricts a maximum of 2 turns on the Zip Line ride per day. The Daily Pass  is subject to applicable Blackout Dates, which are defined as those dates that the Park is not open for any reason or cause, including, but not limited to, private events. The Daily Pass is nonrefundable, nontransferable, may only be used by the Entrant personally, and remains the property of the Park. The Daily Pass is void if altered, duplicated, or misused by the Entrant. The Park reserves the right to cancel, suspend or revoke any Daily Pass or deny Belmont Park admission to any Entrant at any time for any reason. Neither ownership nor use of a Daily Pass guarantees the availability of parking. The Daily Pass is not transferrable and may not be combined with any other offer or promotion. The Daily Pass has no cash value. The nature, operating hours, and availability of Belmont Park, its services and its attractions, and these Terms and Conditions, may change or discontinue indefinitely at the sole discretion of the Park, without notice and free of all liability to the Park 
  
PROCEDURES: Each Daily Pass Entrant must follow the Park’s procedures with respect to the Daily Pass. Additionally, the Daily Pass may not be used for commercial purposes, or those other than for personal use and enjoyment of Belmont Park. Each Entrant agrees, understands, and assumes the inherent risks associated with the operation of all rides and attractions and should read and obey all safety signage, instructions and rules. Entry into Belmont Park constitutes consent for the Park to use all depictions, including but not limited to film, video or reproduction of image, and voice, of any Entrant for any purpose whatsoever without any payment to the Entrant, and such use is granted to the Park by the Entrant free of any liability to Belmont Park. The Entrant agrees that the Daily Pass is only valid during the existing ownership of the Park. If a change in ownership of the Park occurs, it may result in termination of the Daily Pass, as determined by the Park’s successor.   

  
REPLACEMENTS: Any lost or stolen Daily Pass can be replaced at the Park’s sole and absolute discretion by calling the Daily Pass Management line at (858) 488-1549.  To replace the Daily Pass of a child under age 18, the child must be accompanied by a parent or guardian.  
  
VIOLATIONS: The Park may suspend or permanently revoke the Entrant’s Daily Pass, without notice or hearing and without any liability whatsoever to the Park, for any reason in its sole and absolute discretion, including without limitation for any violation of these Terms and Conditions or Park rules (which such Park rules may be determined and/or changed by the Park at any time in its sole and absolute discretion). Entrant must also abide the standard code of conduct of Belmont Park to ensure the safety of and well-being of other Entrants, guests, employees, volunteers and vendors. Violation of the foregoing may result in cancellation of the Daily Pass. The Park will not issue any refund for a suspended or revoked Daily Pass as a result of such termination or violation. 

INDEMNITY: Entrant acknowledges and agrees, at its sole cost and expense, to indemnify, defend (with counsel chosen by the Park), and hold harmless the Park, Symphony Asset Pool XVI LLC, a Delaware limited liability company, San Diego Coaster Company LLC, a California limited liability company,  PE Management Group Inc., a California corporation, Pacifica Enterprises Investments LLC, a Delaware limited liability company, the City of San Diego, and each of their related companies, parent companies, tenants, subsidiaries, successors, attorneys, and affiliates and each of their employees, agents, Entrants, managers, officers, directors and independent contractors and each of them (collectively, the “Belmont Park Parties”) from and against any and all claims, actions, losses, damages, injuries, and/or expenses (including attorneys' fees) or proceedings brought, incurred, or claimed by any person against the Belmont Park Parties with respect to any and all of the matters arising out of or resulting from or in connection with these Terms and Conditions, the Entrant’s use of the Daily Pass and/or the Entrant’s presence at Belmont Park’s property, including without limitation use of rides, food venues, games and other Belmont Park attractions, except if solely arising from the Park’s gross negligence or willful misconduct.   

ASSUMPTION OF RISK: Entrant hereby acknowledges and voluntarily assumes the risk of injury, loss or damage arising out of or relating to its use of Belmont Park or any ride or attraction thereof, whether caused by an act or omission on the part of the Park or otherwise. Entrant understands that participation in the Daily Pass is voluntary and at its own risk.   

GOVERNING LAW AND SEVERABILITY: These Terms and Conditions shall be governed by and construed under the laws of the State of California, without regard to its conflicts of law principles. If any provision of Terms and Conditions is invalid or unenforceable, such provision shall (i) be modified to the minimum extent necessary to render it valid and enforceable, or (ii) if it cannot be so modified, be deemed not to be a part of these Terms and Conditions and shall not affect the validity or enforceability of the remaining provisions. 

AMENDMENT AND WAIVER: These Terms and Conditions may be amended only by a written agreement signed by all parties hereto. Waiver of any provision of these Terms and Conditions shall not be deemed or constitute a waiver of any other provisions, nor shall such waiver constitute a continuing waiver.
